1. Acceptance of Terms
These Terms & Conditions ("Terms") govern your use of www.dealercash.net (the "Site") and any loan application submitted through it. By using the Site or submitting an application, you agree to these Terms. If you do not agree, please do not use the Site.
2. Eligibility
To use the Site or apply for a loan, you must be at least 18 years old, able to enter into a binding contract, and able to provide a lien-free (or nearly lien-free) vehicle title, valid identification and the other information requested in the application.
3. Description of Services
The Site allows you to submit an application for a title loan and describes DealerCash's products generally. Nothing on the Site is a guarantee of approval, and all information is provided for general informational purposes only.
4. Not a Loan Offer
Submitting an application, or any estimate shown on the Site (including the loan calculator), is not an offer, approval or commitment to lend. Actual eligibility, loan amount, fees, payment schedule and terms are determined after review of your application and are set out in your signed Loan Agreement, which controls over anything shown on the Site.
5. Accuracy of Information
You agree to provide true, current and complete information in your application and to promptly update it if it changes. Providing false or misleading information may result in denial of your application, cancellation of any loan, and other action permitted by law.
6. Use of the Website
You agree not to: use the Site for any unlawful purpose; attempt to gain unauthorized access to the Site or its systems; interfere with the Site's operation; scrape or harvest data from the Site; or impersonate another person when submitting an application.
7. Intellectual Property
The Site's content, design, logos and trademarks are owned by or licensed to DealerCash and may not be copied, reproduced or used without our prior written consent.
8. Third-Party Links & Services
The Site may link to, or use, third-party services (for example, to securely transmit your application). We are not responsible for the content, accuracy or practices of third-party sites or services.
9. Disclaimers
The Site is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
10. Limitation of Liability
To the fullest extent permitted by law, DealerCash will not be liable for any indirect, incidental, special or consequential damages arising from your use of the Site, even if advised of the possibility of such damages.
11. Indemnification
You agree to indemnify and hold DealerCash harmless from any claims, losses or expenses arising from your misuse of the Site or violation of these Terms.
12. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles, and any dispute will be subject to the exclusive jurisdiction of the state or federal courts located in Texas.
13. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date above reflects the most recent revision. Continued use of the Site after changes take effect means you accept the updated Terms.
